Photo Rights, Gallery Retention and Promotional Consent
Version 1 · prepared September 25, 2026
Who owns your photos, what you can do with them, how long your gallery lasts, and how optional promotional permission works.
Copyright and your licence
The photographer generally owns copyright in the photos they create, unless a signed written agreement says otherwise.
Every booking includes a non-exclusive licence to download, print, display and share your delivered photos for personal, non-commercial purposes. A booking clearly labelled as a business package also includes a licence to use them in your own business's marketing: your website, social profiles, proposals and advertising.
Reselling, stock licensing, sublicensing, or licensing to unrelated third parties is not included unless the photographer agrees in writing. The licence does not transfer copyright. It continues after your account closes or your gallery expires for files you have already downloaded. Any use must respect the privacy and other rights of the people pictured.
How long your gallery lasts
Your gallery is private and delivered through short-lived links.
Delivered galleries currently stay available while we finish our retention system. When it starts, galleries will be available for 90 days after delivery plus a 30-day Last Chance Recovery period, and we will give you notice before any existing gallery expires. Please download your photos.
Optional promotional permission
GenieGalleries and your photographer may only use images from your gallery for portfolio, website, social or advertising purposes if you tick a separate, optional box. It is never pre-ticked, never required to book or receive your photos, and never bundled with the terms. Saying nothing means no.
The box says:
I give GenieGalleries and the photographer permission to use the selected images from this gallery for portfolio, website, social-media and promotional/advertising examples. This is optional and is not required to receive my photos or complete my booking. I can withdraw permission for future use by contacting Support. I confirm that I am authorized to give permission for the people shown; separate permission is required from other adults, and a parent/legal guardian must authorize use of a minor's image.
We record which booking it covers, the wording and version you saw, when you gave it, and when you withdraw it. You can withdraw it from your booking page or by contacting Support. We then stop new promotional uses and remove the images from channels GenieGalleries controls within a reasonable time; copies already shared by third parties may not be recoverable. This permission is about your likeness and privacy; it does not transfer copyright.
