Photographer Marketplace Agreement
Version 2 · prepared September 25, 2026
The terms for independent photographers offering services through GenieGalleries: the relationship, earnings and holds, professional duties, image use, and disputes.
1. Relationship and accepting work
You operate an independent photography business. You are not promised any minimum volume of work, hours, earnings or exclusivity. You may accept or decline any offered shoot, you control your professional methods and equipment, and you bear your ordinary business expenses. You are responsible for your own business records, income tax, registrations, and any licences or insurance the law requires.
GenieGalleries may set customer-facing package requirements, safety and quality standards, the payment workflow, and the service outcomes needed to run the marketplace. A label in this agreement does not decide legal status if actual conduct differs, and both parties agree to operate consistently with an independent-provider relationship.
Your service contract is with the customer for the confirmed photography deliverables. GenieGalleries provides matching, booking, marketplace administration, payment coordination, gallery tools and support. The operator for this agreement is:
- Legal operator: GenieGalleries
- Business address: 291 St Anne Rd, Winnipeg, MB
- Email: support@geniegalleries.ca · Phone: 2049971940
2. Commission and earnings
- Basic bookings: you receive 70% and GenieGalleries retains 30% of the eligible service amount.
- Gold bookings: you receive 70% and GenieGalleries retains 30%.
- Premium bookings: you receive 60% and GenieGalleries retains 40%.
The eligible service amount is the customer's service price after discounts and before separately stated tax. Tax collected for government is excluded from both shares. Payment-processing fees are GenieGalleries' cost and are not deducted from your share. Tips, if offered, are 100% yours.
Every offer shows your percentage, the eligible amount it applies to, how tax is treated, any separately agreed deduction, and your estimated earnings, before you accept. An offer whose tier or split is missing or inconsistent is not sent.
If a customer cancels less than 24 hours before a shoot, the 20% late-cancellation charge is paid to you for your blocked time (subject to any tax treatment the law requires). It is not a completed-booking commission. It is credited to your earnings once our team has decided the customer's cancellation request, reduced by anything refunded above the schedule (for example in a documented emergency), shared with any other photographer confirmed on the shoot in proportion to what the shoot would have paid each of you, and becomes withdrawable after the usual 5-business-day hold. Nothing is paid where the cancellation was your or GenieGalleries' fault, or the customer received a full refund.
3. When earnings are paid
Earnings become eligible once the gallery is delivered and the customer-satisfaction hold of 5 business days has ended with no open case. We may release earlier where a recorded customer confirmation and other reliable evidence support satisfaction and low dispute risk.
A customer complaint pauses only the unpaid amount for that shoot while it is reviewed. Earnings from your other completed shoots are not frozen unless there is a separate lawful reason. If the case closes without a refund or adjustment, the earnings are released.
You may request withdrawal of eligible earnings once they reach CA$100. We aim to initiate payment within 1–3 business days; banks, payment providers, verification holds and payment-network rules affect when it arrives.
4. Professional duties
- Deliver the accepted scope and quality commitments.
- Keep your profile and availability accurate, arrive prepared, and communicate promptly.
- Follow permits, venue rules, and privacy, copyright and safety law.
- Protect customer information and keep a customer's identity confidential until an accepted shoot needs it.
- Obtain the releases and permissions within your control.
- Never claim background checks, credentials, insurance or expertise that have not actually been verified.
- Do not take payment off the platform to avoid agreed fees or customer protections.
5. Using images from a shoot
You may not use a customer's gallery images in a portfolio, advertising, social media or a competition unless the customer's separate, affirmative image-use permission is recorded for that gallery. A customer booking a shoot is not portfolio permission. If permission is withdrawn, stop new uses promptly.
You confirm you own, or have permission for, everything you upload to your profile, and you will respond promptly to credible copyright or privacy complaints.
6. Responsibility
You are responsible for your professional service, equipment, assistants or subcontractors, and conduct, except where a loss was caused by GenieGalleries' own breach or a duty it cannot exclude. You will indemnify GenieGalleries only for third-party losses directly caused by your proven unlawful act, infringement, negligence or material breach, to the extent the law allows, and only after reasonable notice, a chance to take part in the defence, and your consent to any settlement.
7. Reviews, holds and account action
Customer complaints follow the review process in the Customer Terms. You receive the issue and relevant evidence and have a chance to respond. We record the review, satisfaction outcome, remedy, payout decision and reasons.
Repeated no-shows, safety violations, fraud, image-rights violations or serious harm to a customer may lead to restrictions on your account after a fair review, with immediate protective action where necessary.
8. Tax information
Business and GST/HST registration details are optional at onboarding where the law does not require them. If platform-reporting, payment or tax law requires your seller identity or tax number, we will ask for it securely, and we may have to pause bookings or payouts until it is provided.
9. Disputes
Raise disputes through Photographers@GenieGalleries.ca or our contact form. We first use the internal review, then either side may propose voluntary mediation. Arbitration is not mandatory under this agreement; after a dispute exists, both sides may separately agree to an accessible arbitration process. Otherwise the competent courts and tribunals remain available. Nothing here waives any employment or statutory right you have.
